The Legal Basis

How Utah law makes this possible for couples anywhere in the world.

What if the couple doesn't live in Utah?

That's fine! As long as they were married via Utah County, they can file for divorce through Utah courts regardless of where they currently live.

Utah Code § 30-1-6

Utah recognizes marriages performed by proxy (i.e. via videoconference) so long as the marriage license was issued in Utah County. Thus, an uncontested divorce can be filed in Utah County, and the court retains jurisdiction based on the original licensing.

Personal Jurisdiction Already Established

When couples complete their online marriage license, both spouses sign affidavits consenting to personal jurisdiction in Utah for divorces and annulments. This means the legal groundwork for a future divorce is already in place from day one.

See: Utah Code § 81-2-303(5)(a)(ii) – personal jurisdiction. Effective September 1, 2024, Utah Code § 81-4-402(1)(c) confirms that couples who have consented to personal jurisdiction are eligible to file for divorce in Utah, even if neither party resides in the state.
