Frequently Asked Questions
Find answers to common questions about our online divorce service.
How long does the online divorce process take?
Most users complete our questionnaire in about 1-2 hours. We prepare Utah divorces only, so the rest of the timeline is the Utah court's.
The timeline typically includes:
- Completing the online questionnaire: 1-2 hours
- Your spouse reviewing and signing the documents through a link we email them
- Filing with the Utah court: you email the signed documents to the court, following the instructions we give you
In Utah there is generally a 30-day waiting period, and the final divorce decree usually arrives by email 4 to 8 weeks after the final papers are filed.
Do I need to appear in court?
Usually not. We prepare uncontested Utah divorces only, where you and your spouse agree on the terms and both sign the paperwork. You file the signed documents with the Utah court by email, following the filing instructions we give you, and an uncontested divorce does not usually need a court appearance.
What if my spouse won't cooperate?
Our service is for uncontested Utah divorces only, where both spouses agree on the terms and sign the paperwork, so we can't help if your spouse won't take part. That is a limit of our service only: another online divorce service, or your local court's own forms, may work for you.
DivorceVirtual does not provide or arrange attorneys or mediators. You may want to consult a family law attorney yourself, or the Utah State Courts Self-Help Center, about your options.
Are your forms guaranteed to be accepted by the court?
For Utah filings, yes. We prepare forms for Utah divorces only, and if a Utah court rejects our forms because they don't comply with the court's format, we'll refund our service fee.
Our guarantee includes:
- Properly formatted documents that meet the Utah court's requirements
- Complete set of forms needed for your specific situation
- Clear filing instructions for the Utah court
Note: This guarantee applies to form acceptance only, not to the outcome of your divorce case.
What is your refund policy?
We refund our service fee in full at any stage if we can't take your case because of your children (you have a child together under 18, still in high school or on the way, or an adult child who depends on you because of a disability), or if the court rejects our forms because they don't comply with the court's format. Otherwise it depends on your Utah case's step: a full refund at Step 1, 50% of the service fee at Steps 2 to 6, and at Steps 7 to 10 a credit for the full amount you paid toward a future service, which does not expire. A court filing fee you paid through us is refunded in full until we've paid the court.
What if we don't qualify for DivorceVirtual?
This is only about what DivorceVirtual covers. It doesn't mean you can't get a divorce online: another online divorce service, or your local court's own forms, may work for you.
