Woman completing divorce forms online

You don't need to live in Utah. If you applied for your Utah County marriage license online, you both signed an affidavit agreeing that Utah courts can handle a future divorce or annulment, so you can file here from anywhere, 100% online.

Is this right for you?

Our joint online divorce is built for one situation. Check you're a fit before you start.

These requirements are for DivorceVirtual only. They don't mean you can't get a divorce online in Utah elsewhere.

A good fit for our service if…

  • Married in Utah County

In person or online (through Utah County directly, or via VirtualMarriage, Courtly, RemoteVows or another online service), wherever you live or have lived.

  • You both agree

Both spouses agree on the terms and are willing to sign the paperwork.

  • Your spouse is reachable by email

You can contact your spouse by email to coordinate signing.

  • No minor children

No children together under 18 or still in high school, none on the way, and no adult child who depends on you because of a disability. Grown, independent children are fine.

Not a fit for our service if…

  • You have a child together under 18, still in high school or on the way, or an adult child who depends on you because of a disability
  • You and your spouse disagree on the terms
  • You can't reach your spouse
  • Your marriage license wasn't issued by Utah County

Frequently Asked Questions

Find answers to common questions about our online divorce service.

Good news! You are NOT required to live or reside in Utah. Recent changes in Utah law allow non-resident couples to file for divorce in Utah if both spouses signed an affidavit consenting to Utah's personal jurisdiction for divorce or annulment. Since all Utah County-issued online marriage licenses require this affidavit, you and your partner should have already completed it.

See: Utah Code § 81-2-303(5)(a)(ii) – personal jurisdiction (read code here).

Effective September 1, 2024, Utah Code § 81-4-402(1)(c) confirms that couples who have consented to personal jurisdiction are eligible to file for divorce in Utah, even if neither party resides in the state (read code here).

Yes. With DivorceVirtual, you both need to agree on the terms, and your spouse signs the documents digitally, by email, from wherever they live. Only one of you fills in our questionnaire. Without your spouse's signature, we can't finish your divorce. That is a limit of our service only: another online divorce service, or your local court's own forms, may work for you.

We prepare Utah divorces only. A Utah divorce usually takes 60-90 days. In Utah there is generally a 30-day waiting period, and the final divorce decree usually arrives by email 4 to 8 weeks after the final papers are filed. Our platform helps you complete your paperwork in as little as 1 hour, and we give you instructions for each step of filing with the Utah court.

Our service is for couples with no minor children. If you and your spouse have a child under 18, a child still in high school, a child on the way, or an adult child who depends on you because of a disability, the divorce needs custody, parent-time or child-support orders that we don't prepare, and we recommend speaking with a Utah family law attorney. That is a limit of our service only: another online divorce service, or the Utah courts' own online forms, may work for you. Grown, independent children don't affect eligibility. For complex financial situations, we may also recommend consulting with an attorney.

No, court filing fees are not included in our pricing. These fees are separate from our service charges.

We refund our service fee in full at any stage if we can't take your case because of your children (you have a child together under 18, still in high school or on the way, or an adult child who depends on you because of a disability), or if the court rejects our forms because they don't comply with the court's format. Otherwise it depends on your Utah case's step: a full refund at Step 1, 50% of the service fee at Steps 2 to 6, and at Steps 7 to 10 a credit for the full amount you paid toward a future service, which does not expire. A court filing fee you paid through us is refunded in full until we've paid the court.

Yes. We prepare your documents on the Utah courts' own online divorce forms. Once filed and approved by the court, your divorce decree is legally binding.

Absolutely. We use bank-level encryption to protect your data. We never sell your personal information; we share it only with the providers that run the service and as our Privacy Policy describes. All communications are confidential, and you can ask us to delete your account at any time. Our Privacy Policy says what that removes and what we keep.
